We operate as a marketplace connecting client families with independent 1099 contractors.

2. Information We Collect
2a. Information from Client Families
When you inquire about or engage our services, we may collect:

Children’s dates of birth, where provided for matching and placement purposes
Payment information, which is collected and stored securely through our payment processor, Elavon/Converge. Night Owl does not store your full credit card or banking details on our own systems.

5. How We Share Your Information

5a. With Care Providers
When a placement is confirmed, we share relevant client family contact information—such as name, address, and phone number—with the assigned care provider so they can fulfill their service obligations. We share only the information necessary for the placement.
5b. With Service Providers
We use third-party platforms to operate our business. These include:
JotForm — intake and inquiry form collection
Google Drive — document storage and internal file management
QuickBooks Online — accounting and financial records (email addresses and, in some cases, contractor tax information)
Elavon/Converge — secure payment processing
Email (Google Workspace) — internal communications and provider coordination
These providers are engaged to support our operations and are not authorized to use your information for their own purposes.
5c. As Required by Law
We may disclose information when required to do so by law, legal process, or government authority, including for tax reporting purposes.

Contractor tax information is retained in accordance with applicable federal and state tax law. Client family information is retained for the duration of the service relationship and for a reasonable period thereafter.

We take the security of your personal information seriously. We use the following measures to protect it:
Payment information is processed exclusively through Elavon/Converge, a PCI-compliant payment processor. Night Owl does not store full payment card or bank account details.
Contractor tax identification information is stored in Google Drive with access restricted to authorized Night Owl personnel.
We limit access to personal information to staff and contractors who need it to perform their designated functions.
No method of electronic transmission or storage is 100% secure. While we use commercially reasonable safeguards, we cannot guarantee absolute security. If you have concerns about a specific piece of sensitive information, please contact us directly.
8. Children’s Privacy
Our services are provided to adult client families, and we do not knowingly collect personal information directly from children under the age of 13. We may receive limited information about children in a client family’s care—such as a date of birth—solely for the purpose of matching families with appropriately qualified care providers. This information is not used for any other purpose, is not sold or shared beyond what is necessary for placement, and is handled with heightened care.
